The first hearing of a trail connected to the 12 and 13 August incident was held
on Monday.
In the hearing that took place at the Juvenile Court, charges were brought
against a minor 17 years old court officials said. The court declined to
disclose the name of the the accused because the accused was not yet 18 years
old.
The State is pressing charges of disobedience to order under under (a) of
article 88 of the Penal Code and breaching public peace in an unlawful assembly
under article 50 of the Penal Code with reference to Article 46, the court said.
However, in the first hearing the accused had reportedly pleaded not guilty to
these charges.
If a person was proven guilty under article 88 of the Penal Code he carries a
sentence of exile or imprisonment or house detention not exceeding 6 months or a
fine not exceeding Mrf. 150.00. If proven guilty under article 50 of the Penal
Code the sentencing include imprisonment for a period between 1 year and 4 years
or exile between 2 years and 8 years or fine not in excess of Mrf. 4,000/-.
However if any of these offences were proven on a minor not 18 years old, the
child shall serve the sentence under house detention and the sentence will be
reduced to one third.
