FAST MOTION SUBMITTED TO THE PEOPLE’S MAJLIS

MOTION
Whereas the issue of the treatment by the detaining authorities, of those
accused of different crimes detained for investigations and those detained in
jail to serve sentences passed on by the courts, is a matter of concern to the
public;
Given that any failing on the accountability of those upholding the Nation’s and
public security is a defect that may blemish the National Interest;
Given that strengthening such accountability is paramount to the National
Interest;
A Motion is submitted to set up a People’s Majlis Committee to examine how those
detained for investigations and those detained to serve sentences were treated
and are being treated.
SHORT PREAMBLE TO MOTION
1. It is noted that various complaints have been received regarding the
treatment of those detained with regards to the aforementioned 2 reasons. Among
these complaints, stories of physical and sexual abuse as well as psychological
abuse have become public knowledge. As a result the trust required to be given
to the Security Personnel by the public are being lost.
2. Due to the great number of such complaints and in order to increase
credibility the Government had taken measures in the past but the objectives of
which had been diverse. Such measures include:
(a) Conducting investigation on the death in custody of Suda of Lonumidili-ge of
Maafannu District of Male’ who was serving a sentence in jail. However the
results of the investigation were not made public in a satisfactory fashion.
(b) Conducting investigation on the death in custody of Ali Shahir of Dullisaa
of Machangoli District of Male’
(c) Conducting investigation on the murder in jail of Evan Naseem of Asia of
Maafannu District of Male’ on 19 September 2003. Investigations were also
conducted on the incident of shooting and murder of jail inmates on 20 September
2003.
(d) Recently a detainee, Muaviath Mahmood of Raivina of Maafannu District, have
died inexplicably while being held for investigations. Appropriate measures have
not been taken as yet to investigate the matter.
(e) Mohamed Ibrahim, Yamyam-ge of Maafannu District of Male’, having being
abused to a life-threatening condition whilst detained for investigations, is
presently undergoing medical treatment.
These cases took place overtly and among them were cases that might have caused
unrest and that did cause unrest.
3. In addition to these we are getting [many such] complaints from the
destitute. Appropriate redress has not been given to these complaints.
4. When such incidents were investigated they were conducted by committees that
include Government employees. Despite the fact that in some of these committees
Majlis Members were included, the findings of such committees were not brought
to the Majlis and debated appropriately.
Now therefore things having been as they are, it is deemed that the People’s
Majlis examine this issue now and that the Members should take the
responsibility incumbent upon them as representatives of the people.
